Postdoctoral Chen Jinbo delivered speech in the Workshop and the topic of his speech is “The Historical Fate of The Dual Defendant System in Administrative Reconsideration”. Chen Jinbo stated that the dual defendant system in administrative reconsideration is not conducive to the full relief of the applicant and the substantive resolution of administrative disputes. The administrative reconsideration system is therefore unable to play its due roles. Chen jinbo further explained that the main function of the administrative reconsideration system is right relief rather than administrative supervision. Thus, the agency of administrative reconsideration should be recognized as the third party of the litigation rather than the co-defendant.
